Valley View Photo — Terms of Service

These Terms of Service ("Terms") are a legally binding agreement between Valley View Photo ("Valley View Photo," "we," "us," or "our") and the individual or entity booking, purchasing, or using our services ("Client," "you"). By booking a shoot, placing an order, or using valleyviewphoto.com, you agree to these Terms.

1. Definitions

  • "Services" means any product or service offered by Valley View Photo, including still photography, aerial/drone photography, floor plans, twilight conversions, virtual/3D tours, and any package or add-on combining these.

  • "Deliverables" means the final photos, floor plans, video, virtual tour files, or other media produced by Valley View Photo as a result of the Services.

  • "Property" means the real property identified by the Client for a given Order.

  • "Order" means a specific booking of Services for a specific Property and date.

2. Services

Valley View Photo provides real estate photography and marketing media for properties in the Phoenix metro area and surrounding Valley communities, including:

  • Interior and exterior still photography

  • Aerial/drone photography

  • Floor plans

  • Twilight conversions

  • 3D/virtual tours

  • Bundled package tiers and à la carte add-ons, as described at valleyviewphoto.com

Specific inclusions, image counts, and turnaround times are as described on the Order or package description at the time of booking. Valley View Photo may update package contents and pricing at any time; the terms in effect at the time of your Order govern that Order.

3. Booking, Scheduling & Payment

  • Orders are confirmed once scheduling details are provided and payment (or an agreed deposit) is received.

  • Full payment is due at the time of booking unless otherwise agreed in writing. Deliverables will not be released until payment is received in full.

  • Accepted payment methods are listed at checkout. Returned payments, chargebacks, or failed transactions may result in a hold on future bookings and delivery of media until resolved.

  • Prices are quoted based on the property size, service area, and package selected at booking. Properties requiring travel outside our standard service area may incur an additional travel fee, disclosed before the shoot is confirmed.

4. Cancellations, Rescheduling & Weather

  • Cancel or reschedule more than 3 hours before the scheduled shoot time: No charge.

  • Cancel within 3 hours of the scheduled shoot time, or after the photographer has already arrived on-site (including cases where the property is inaccessible or not "shoot-ready" — e.g., not cleaned/staged, occupied by non-consenting tenants, or unsafe conditions): A flat $25 cancellation fee applies.

  • Weather: If weather prevents a scheduled shoot (including exterior, twilight, or aerial work), Valley View Photo will reschedule at no additional charge. We are not liable for delays caused by weather.

  • Once a shoot has been completed and Deliverables produced, Orders are final; no refunds will be issued for completed work, though we will address quality concerns per our revisions policy below.

5. Property Access & On-Site Conditions

  • Client is responsible for ensuring the property is clean, staged, and accessible (key, lockbox code, or on-site contact) at the scheduled time.

  • Client must disclose any known hazards, unstable structures, aggressive animals, or unsafe conditions prior to the shoot. Valley View Photo may delay, pause, or decline to complete work if a condition presents a safety risk to our photographer or equipment; this is not a breach of the Order.

  • Client is responsible for securing firearms and hazardous materials, and for restraining or removing pets from areas being photographed.

  • Client agrees to reimburse Valley View Photo for any loss or damage to equipment resulting from undisclosed hazards or unsafe property conditions.

6. Aerial/Drone Photography

  • All aerial photography is performed by an FAA Part 107–certified remote pilot in compliance with federal aviation regulations.

  • Some properties fall within restricted or controlled airspace (e.g., near Phoenix Sky Harbor, Scottsdale Airport, or other controlled zones) where drone flight requires advance authorization or may not be legally possible. If airspace restrictions, weather, or on-site safety conditions prevent a drone flight, Valley View Photo will notify the Client; the aerial portion of the Order may be rescheduled, substituted, or refunded at Valley View Photo's discretion, but no other portion of the Order is affected.

  • Client authorizes Valley View Photo to operate a drone over and around the Property for the purpose of capturing the ordered media, in compliance with FAA rules, local ordinances, and any applicable HOA guidelines the Client has disclosed to us in advance.

7. Turnaround, Delivery & Revisions

  • Standard turnaround time is [X business hours/days] from the completed shoot, as stated on the package description. Rush delivery may be available for an additional fee.

  • Deliverables are provided via online gallery/download link. Client is responsible for downloading and archiving files; Valley View Photo is not obligated to retain files indefinitely (see retention note below).

  • Minor correction requests (e.g., a missed edit, color correction adjustment) will be addressed at no charge if submitted within [7] days of delivery. Requests to reshoot due to Client-side changes (staging changed, listing details changed, etc.) are treated as a new Order.

  • Valley View Photo retains completed Deliverables for [90] days after delivery; Client is responsible for downloading and storing files for long-term use.

8. Ownership, Copyright & License Grant

  • Valley View Photo retains full copyright ownership of all photographs, floor plans, video, and other media produced under these Terms, as the original creator, consistent with U.S. Copyright Law (17 U.S.C. § 102).

  • Upon full payment, Client is granted an unlimited, non-exclusive, non-transferable license to use the Deliverables to market and promote the specific Property for which they were ordered — including on the MLS, brokerage websites, social media, print collateral, and syndicated real estate platforms (e.g., Zillow, Realtor.com).

  • This license does not permit Client to: (a) sell, sublicense, or transfer the Deliverables to a third party; (b) use the Deliverables to market a different property; (c) use the Deliverables to promote a listing after Client's representation of that Property has ended, if a different agent or brokerage subsequently represents it; or (d) alter, crop, or remove Valley View Photo's watermark or attribution where one is present, except as reasonably necessary for standard MLS/marketing use.

  • Valley View Photo retains the right to use Deliverables for its own portfolio, marketing, and promotional purposes (including its website and social media), unless the Client requests confidentiality in writing prior to the shoot (e.g., for a celebrity client or an unlisted/off-market property).

  • Retaining copyright allows Valley View Photo to enforce against unauthorized use of Client's listing images by other agents or third parties on Client's behalf.

9. Third-Party Platforms

Valley View Photo delivers 3D tours and floor plans in formats compatible with common platforms (e.g., Matterport, Zillow 3D Home) but does not guarantee syndication, display, or support by any MLS, listing aggregator, or third-party platform, as those systems are outside our control and subject to their own terms of service.

10. Model Releases & Privacy

  • Valley View Photo photographs properties, not people. Client is responsible for ensuring occupants, tenants, or other individuals are not present or visible during the shoot, or for obtaining appropriate consent if they will be.

  • Aerial photography is composed to capture the subject Property; incidental capture of neighboring properties may occur due to the nature of aerial imaging. Client agrees not to use Deliverables in a way that violates the privacy of neighboring property owners.

11. Warranties & Disclaimers

Services are provided on an "as-is" basis. Valley View Photo makes no warranty that Deliverables will meet every subjective expectation of style beyond the professional standards described in our package materials. Except as expressly stated in these Terms, Valley View Photo disclaims all other warranties, express or implied, to the maximum extent permitted by Arizona law.

12. Limitation of Liability

To the maximum extent permitted by law, Valley View Photo's total liability arising out of or relating to any Order is limited to the amount paid by Client for that Order. Valley View Photo is not liable for indirect, incidental, consequential, or special damages, including lost profits or lost sales opportunities, arising from delayed delivery, technical issues, or third-party platform failures.

13. Indemnification

Client agrees to indemnify and hold harmless Valley View Photo from any third-party claims, damages, or legal fees arising from: (a) Client's use of Deliverables outside the scope of the license granted here; (b) inaccurate property information or non-disclosure of hazards provided by Client; or (c) Client's violation of these Terms or applicable law.

14. Force Majeure

Valley View Photo is not liable for delay or failure to perform Services due to causes beyond our reasonable control, including severe weather, natural disaster, government restriction, or airspace closure affecting drone operations.

15. Term & Termination

These Terms remain in effect for the duration of the business relationship between Valley View Photo and Client. Either party may decline future Orders at any time. Provisions that by their nature should survive (ownership/license, limitation of liability, indemnification, confidentiality) survive termination.

16. Confidentiality

Any non-public business or personal information shared between Client and Valley View Photo in connection with an Order (e.g., unlisted property details, access codes) will be treated as confidential and used only to fulfill the Order.

17. Governing Law & Disputes

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Any dispute arising from these Terms shall be resolved in the state or federal courts located in Maricopa County, Arizona.

18. General Provisions

  • Entire Agreement: These Terms, together with any specific Order details, constitute the entire agreement between the parties regarding the Services.

  • Severability: If any provision is found unenforceable, the remaining provisions remain in full effect.

  • Amendment: Valley View Photo may update these Terms at any time; the version in effect at the time of an Order governs that Order. Continued use of our Services after changes constitutes acceptance.

  • Assignment: Client may not assign these Terms without our written consent.

  • Notices: Notices under these Terms should be sent to the contact information below.
